The Netherlands has implemented the Photocopying/photo-reproduction (Art. 5.2(a) InfoSoc) exception in Artikel 16h. The national exception is slightly more restrictive than the EU exception.

Implementation summary:

Exception allowing reproductions of articles in daily or weekly newspapers or magazines, or of small sections of books and other works included in such works, provided that a remuneration is paid. In the case of books for which it may reasonably be expected that no new copies are made available to third parties in any form whatsoever in return for payment, the exception allows the reproduction of the whole work.

Remarks: The above mentioned limitations do not apply to government entities, libraries and educational institutions. The decision on reprographic reproduction allows them to make a wider scope of authorized reproductions.
